Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the LocalKids website and services at localkids.com.au (the “Service”). The Service is operated by [[LEGAL_ENTITY_NAME]] (ABN [[ABN]]) (“LocalKids”, “we”, “us”, “our”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. What LocalKids is (and is not)
LocalKids is a discovery directory that helps families find children’s activities, classes and programs run by third-party providers. LocalKids is an information and listing service only.
LocalKids is not:
- a booking, enrolment or ticketing service — we do not take bookings or reserve places on your behalf;
- a payment service — we do not take payment for activities, and we are not a party to any transaction between you and a provider;
- a general vetting, accreditation or background-checking service. We do not independently vet providers or their staff. Where a listing shows a “Verified” label against a specific claim (such as NDIS registration, a Working with Children Check, insurance or first-aid training), it means only that a provider gave us evidence for that claim and we reviewed it at a point in time — see section 4A. It is not an ongoing guarantee, and you must still make your own checks;
- an agent of, or responsible for, any provider listed on the Service.
Any features described as “enrolled”, “planner”, “waitlist” or similar are organisational tools for your own reference. Marking something as “enrolled” tells us your intention — it does not create, confirm or pay for a booking with the provider.
2. Eligibility
The Service is intended for use by adults aged 18 or over who are the parent or legal guardian of the child or children the activities relate to, or who are otherwise authorised to act for them. By using the Service you confirm you meet this requirement. The Service is not directed at children, and children should not use it to provide personal information. Any information about a child must be entered by a responsible adult on that child’s behalf.
3. Acceptable use
You agree not to:
- use the Service unlawfully, or for any fraudulent, harmful, harassing, defamatory or misleading purpose;
- submit content that is false, offensive, infringing, or that impersonates another person or business;
- post a review or rating for a business you have a conflict of interest in (e.g. your own business or a competitor’s), or attempt to manipulate ratings;
- scrape, harvest, or bulk-download data from the Service, or attempt to access areas or accounts you are not authorised to access;
- interfere with, disrupt, or attempt to circumvent the security of the Service;
- use the Service to send spam or unsolicited communications.
4. Accounts and provider listings
Some listings are created by us from publicly available information and may be unverified until claimed by the provider. We label unverified and unclaimed listings accordingly. Information in a listing (including pricing, schedules, availability, contact details and descriptions) may be incomplete, out of date, or inaccurate. Always confirm details directly with the provider before relying on them, making plans, or making a payment.
If you are a provider and claim or submit a listing, you are responsible for the accuracy of the information you provide, and you grant us the right to display it. If a listing relates to your business and you did not create it, you can claim it, request changes, or request its removal — see listing removal & opt-out.
4A. Verified claims and ranking
Verified claims. Providers may submit evidence for certain claims (for example NDIS registration, a Working with Children Check, insurance or first-aid training). Where we mark such a claim as “Verified”, we have reviewed the evidence the provider supplied at a point in time. A “Verified” label is not a guarantee that the claim remains current or complete, is limited to the specific claim shown, and does not make us responsible for the provider. Claims without a “Verified” label are self-reported by the provider and unchecked. You remain responsible for confirming a provider’s checks, registrations, insurance and suitability directly with them.
Ordering and personalisation. The order in which listings appear — and, for signed-in users, any personalisation based on your saved activities, interests or children’s ages — is intended to be helpful, not an endorsement, recommendation or ranking of quality. Ordering may reflect relevance, availability, engagement and paid placements (which are labelled). You can turn personalisation off in your profile, as described in our Privacy Policy.
5. User-generated content
“User Content” means anything you submit to the Service — including reviews, ratings, questions, answers, enquiries and messages. You retain ownership of your User Content. By submitting it, you grant LocalKids a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display and distribute that content for the purpose of operating and promoting the Service.
You are solely responsible for your User Content and confirm you have the right to submit it and that it is accurate and not misleading. We do not pre-screen or monitor User Content and are under no obligation to do so. However, we may — at our discretion and without notice — remove, edit or refuse to publish any User Content, including content we consider inaccurate, unlawful, defamatory, offensive or in breach of these Terms.
If you believe any content on the Service is inappropriate, inaccurate or infringing, you can report it using the “Report” control shown alongside reviews and other user content, or by contacting us at [[CONTACT_EMAIL]]. We aim to review reports and take appropriate action.
6. Disclaimers
The Service and its content are provided “as is” and “as available”. To the maximum extent permitted by law, and subject to section 7, we make no warranties or representations about the accuracy, completeness, reliability or suitability of any listing, provider, activity or content.
Any activity you attend or arrange is a matter between you and the provider. We are not responsible for, and do not endorse or guarantee, the conduct, safety, qualifications, insurance, or the quality or outcome of any provider or activity, and we accept no liability for any injury, loss or damage arising from your dealings with, or attendance at, any provider or activity. You are responsible for satisfying yourself that a provider and activity are suitable and safe for your child, including confirming the provider’s Working with Children Checks, supervision, insurance and safety practices.
7. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded (“Non-excludable Rights”). Where our liability for breach of a Non-excludable Right can be limited, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of having them re-supplied.
8. Limitation of liability
Subject to section 7, to the maximum extent permitted by law, LocalKids will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Service. Subject to section 7, our total aggregate liability arising out of or in connection with the Service is limited to AUD $100.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless LocalKids from any claims, losses, liabilities and expenses (including reasonable legal costs) arising from your breach of these Terms, your User Content, or your misuse of the Service.
10. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
11. Third-party links
The Service links to third-party websites (including provider websites and booking platforms). We are not responsible for the content, practices or availability of those sites, and linking does not imply endorsement.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Your continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and LocalKids submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
